Katie Trotter represents clients in bankruptcies, out-of-court restructurings and general commercial litigation matters. Her clients include banks, special servicers and government-sponsored credit providers.
  
Prior to joining Parker Poe, Ms. Trotter worked in the financial restructuring groups of two law firms in New York City. She also clerked for The Honorable J. Rich Leonard, Chief Judge of the U.S. Bankruptcy Court for the Eastern District of North Carolina.

Representative Matters

  • Represented a large national bank in Chapter 11 cases where the bank had provided approximately $21 million in working capital financing – assisted with successfully defending the bank in adversary proceedings challenging the validity, priority and extent of its interests in certain collateral, and negotiating the terms and conditions of a 363 sale of the debtors’ assets; the sale won the 2011 TMA Small Deal Transaction of the Year
  • Represented a national manufacturer debtor in a Chapter 11 case that successfully liquidated its assets through the bankruptcy, resulting in the satisfaction in full of all secured debt claims
  • Represented a utility provider debtor in a Chapter 11 case that successfully reorganized pursuant to a confirmed plan of reorganization, resulting in the satisfaction in full of all secured and unsecured debt claims
  • Represented an official unsecured creditors’ committee in a Chapter 11 case where the debtor successfully reorganized through a plan of reorganization that distributed equity in the new corporation to the unsecured creditors in full satisfaction of their claims
  • Obtained relief of stay for numerous clients in both Chapter 7 and Chapter 11 bankruptcy cases

Experience Highlights

  • Bankruptcy proceedings involving use of cash collateral, approval of postpetition financing, the sale of estate property free and clear of liens and the cram down of a plan of reorganization
  • General commercial litigation, including actions based on breach of promissory notes and guaranties, actions to obtain the appointment of a receiver and actions seeking judicial foreclosure
  • Assisting financial services clients with negotiating, drafting and enforcing loan forbearance and loan modification agreements
  • Working with borrowers to complete out-of-court restructurings for the benefit of creditors
