John Amabile prides himself on practicing the art of litigation and seeks to partner with clients to obtain the best results for their business. A seasoned commercial litigator, he has first-chair, lead attorney experience in state and federal courts of all levels. He has tried dozens of cases to judges, juries, and arbitrators, has represented parties in more than 250 mediations, and has resolved hundreds of disputes. This experience allows John to identify and obtain the most cost-effective resolution for the benefit of his clients.

John's experience is with diverse clientele, including those from the manufacturing, real estate, logistics, consumer goods, and technology industries. He has represented clients in substantive areas of the law as wide ranging as securities, international commerce, arbitration provisions, operating agreements, real estate contracts, and construction defects. His litigation experience over 30 years has taught him that the most important task in any lawsuit is identifying issues. That is not limited to issues raised in a dispute but also identifying those issues that motivate the litigation decision. John's strength is in helping clients identify these issues, making an appropriate and cost-effective decision, and obtaining the best result, inside or outside a courtroom.

John prides himself on working with clients on multiple matters over a period of years, and he seeks to develop long-lasting relationships as both an attorney and an advisor. 

Representative Experience

  • Successfully defended a leading global technology company in arbitration related to a claim of fraudulent inducement of a contract; the arbitrator ultimately awarded less than 1% of the $6 million the claimant sought in damages.
  • Represented Mexican manufacturer in arbitration before the International Centre for Dispute Resolution (ICDR) involving $40 million contractual dispute. 
  • Acted as national trial counsel for a New York real estate company accused of securities fraud arising from the sale of tenant in common interests; won motions to enforce applicable arbitration agreements in each state and then arbitrated the claims.
  • Represented multiple REITs in commercial, construction, and property disputes.
  • Won motions in multiple federal courts to enforce arbitration provisions in a nationwide securities dispute.
  • Represented a software developer in arbitration over a customer dispute related to the creation of custom software.
  • Led the defense in North Georgia of multiple synthetic stucco claims against homebuilders.
  • Obtained a dismissal of a multimillion-dollar lawsuit based on the discovery abuses of the opposing party.
  • Negotiated a multimillion-dollar consent judgment against a developer on claims arising from the $150 million sale of a shopping center.
  • Represented an insurance company in post-verdict motions and appeals after excess verdict on direct action claim. 
  • Represented clients in multimillion-dollar disputes seeking to enforce contractual obligations and rights under operating agreements. 
  • Refined arbitration agreements for corporate contracts to help clients navigate the latest U.S. Supreme Court and lower court precedents.
