Tim Logan advises companies and individuals in the acquisition, sale, development, leasing, and financing of commercial real estate. Tim has experience representing developers in industrial, multifamily, single-family, and retail acquisitions and dispositions, including advising corporations in the acquisition of industrial properties as they relocate to North Carolina and the sale of industrial properties with environmental challenges. Tim also represents developers of master-planned communities. 

Tim also represents borrowers in corporate finance transactions, including loans secured by real estate, portfolio finance transactions, syndicated loans, asset-backed financings, and loans from Fannie Mae and Freddie Mac. Based on his previous experience representing lenders, including the origination and servicing of securitized loans, Tim is able to protect his clients’ interests while working efficiently to close a deal. Tim also assists borrowers with North Carolina local counsel opinions.

Outside of work, Tim can be found coaching his boys’ youth sports teams. Tim is a member of the Urban Land Institute (ULI) and the Industrial Asset Management Council.

He serves as a chair of the firm's Recruiting Committee.

Representative Experience

Real Estate 

  • Represents a developer in a multi-year project to assemble and acquire 1,400 acres in Charlotte and develop a mixed-use, master-planned community with commercial and residential uses. Assists the client with initial and ongoing cost-sharing agreements, allocating common area maintenance responsibilities between associations and owners as additional parcels are sold to builders throughout the development process.
  • Represents a national retailer in acquisitions and dispositions of real property throughout the United States.
  • Represented developers in assemblages for single-family developments, and drafting declarations of covenants and restrictions for resulting neighborhoods.
  • Represented a private equity firm in the disposition and management of a portfolio of leased and owned real estate assets, including lease modifications, assignments of leases, lease terminations, and transfers of real property.
  • Represented retailer in the acquisition of parcels to be used for fuel stations across the Southeastern United States.
  • Analyzed real estate title, subdivision declarations, articles and bylaws of homeowners’ associations, as well as tax records and local governmental approvals to inform a foreclosing bank of any potential adverse effects of owning real properties and to minimize any liability of taking possession of the properties.
  • Represented multifamily owner in reverse and forward looking 1031 exchanges.

Finance

  • Represented public company in nearly $3 billion of syndicated secured credit facilities, including new and used vehicle floor plan, letter of credit, working capital, and swing line facilities.
  • Represented private company in $450 million syndicated, asset-backed revolving and letter of credit facility.
  • Represented public company in a $500 million loan secured by a portfolio of real estate located in over 15 states.
  • Represented real estate joint venture in $86.5 million real estate acquisition and construction loan.
  • Represented borrower in $18.665 million Freddie Mac loan secured by real property.
  • Served as bank counsel in the origination and servicing of securitized loans. Drafted and negotiated loan documents, performed corporate and real estate due diligence, corresponded with lenders, borrower’s counsel, and other parties to close loan transactions.

Industrial Development

  • Represented foreign food manufacturer in acquisition of initial site in a government sponsored industrial park, including negotiation of acquisition contract, park covenants, and development agreements.
  • Represented foreign manufacturer in acquisition of site requiring recombination of parcels to create suitable building site and purchase option for future plant expansion.
  • Represented manufacturer in sale-leaseback of existing facility and lease of newly acquired adjacent parcel for expansion of plant.
  • Represented seller of heavy manufacturing plant with ongoing environmental monitoring requirements.
  • Represented developer in assemblage acquisition and development of new life sciences industrial park.
  • Represented manufacturer in sublease of facility with ongoing environmental monitoring obligations.
