In K-12 Dive, Nina Gupta was quoted on the U.S. Department of Education’s proposed Title IX athletics rule, which would prevent schools from categorically banning transgender students from playing on sports teams aligning with their gender identities. The proposal would under some circumstances, however, permit sex-related criteria to limit participation of transgender students.

The proposal has elicited concerns both from advocates for additional inclusivity and from groups that worry girl athletes would be harmed.

“By trying to straddle both of these — and I think legitimate — concerns, they’ve made no one happy,” Nina said. “So they will get sued by everybody, rather than [if they had gone] hard one way or the other.”
