Public Comment Rules: First Amendment Considerations for School Boards

Nina Gupta and Suzann Wilcox led a discussion on First Amendment considerations for school boards during the Council of School Attorneys (COSA) Spring Law Seminar in Atlanta. 

Nina and Suzann explored how school districts can balance the public’s right to free speech with maintaining order and decorum during public school board meetings. These meetings have increasingly become arenas for contentious public comment, raising First Amendment challenges and the need for well-crafted public comment policies. 

Nina and Suzann also presented on navigating the Office for Civil Rights (OCR) and Title IX compliance. This year’s seminar also included Parker Poe attorneys presenting on safeguarding student data and the impact of recent federal litigation on school districts.

COSA’s seminar brought together school attorneys from across the country for presentations and legal education on current law and litigation affecting public schools. COSA is part of the National School Boards Association.
